These Terms apply to your use of myGermanDictionary.com (the “Website”), operated by Drazen Pavkovic (the “Operator”).
By creating an account or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
The Website is a free, independently maintained hobby project that provides tools for language learning, including personal dictionaries, lessons and vocabulary practice.
Development, maintenance and support depend on the Operator’s available time and resources. No service-level agreement, minimum availability, response time or commitment to continued operation is provided.
The Website and its content and features are provided “as is” and “as available”.
To the fullest extent permitted by applicable law, the Operator disclaims all express and implied warranties, including warranties of accuracy, reliability, availability, fitness for a particular purpose and non-infringement.
The Operator does not warrant that the Website will operate continuously, be free of errors or vulnerabilities, meet your requirements, or that defects will be corrected.
Learning materials, translations, examples and other information may contain mistakes. No particular learning outcome is guaranteed.
The Website is not a backup or archival service. You should not use it as the only place where you store content you wish to keep.
Your dictionaries, lessons, learning progress and other stored information may become unavailable, corrupted or permanently lost, in whole or in part. Possible causes include software errors, failed updates, hardware or hosting failures, security incidents and discontinuation of the Website.
The Operator does not provide a guaranteed backup schedule, retention period, recovery time or recovery point. Backups, where available, may be incomplete or out of date. Restoring a backup may result in the loss of entries and changes made after that backup was created. Recovery may not be possible.
You are responsible for keeping independent copies of content you wish to retain. Use the dictionary export feature regularly, and retain original copies of texts and other materials you upload.
Subject to Section 4, the Operator is not liable for the loss, corruption or unavailability of your content, or for the cost or time involved in recreating it.
To the fullest extent permitted by applicable law, the Operator shall not be liable for any loss or damage arising out of or connected with your use of, or inability to use, the Website.
This exclusion includes direct, indirect, incidental and consequential losses, loss or corruption of data, loss of learning progress, loss of profits or opportunities, business interruption, and the costs of recovering or recreating content.
It applies to the extent permitted by law regardless of the legal basis of the claim, including contract or negligence, and even if the Operator was advised that such loss or damage was possible.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, or any other liability that cannot lawfully be excluded or limited. Nothing in these Terms removes mandatory consumer rights or rights under applicable data protection law.
You are responsible for keeping your login credentials confidential and for your own use of the Website.
You must not use the Website to distribute unlawful content or spam, harass others, infringe another person’s rights, gain unauthorised access, or disrupt the Website or its infrastructure.
Only upload content that you have the right to use. The fact that a lesson is private does not itself establish permission to copy or upload copyrighted material.
Do not upload confidential information or sensitive personal information about yourself or others.
You retain any ownership and intellectual property rights you hold in the content you upload. These Terms do not transfer ownership of your dictionaries, lessons or other content to the Operator.
You grant the Operator a non-exclusive, royalty-free permission to host, store, copy and technically process your content only as needed to provide, maintain and secure the Website and its features for you.
This permission does not authorise the Operator to publish your private lessons or personal dictionary entries as shared content for other users.
Personal data is handled as described in the Website’s Privacy Policy.
Features may change, and parts of the Website may be temporarily unavailable during maintenance, development or incident response.
The Operator may suspend or restrict access where reasonably necessary to address misuse, security risks, breaches of these Terms or legal requirements. Immediate action may be taken where necessary.
The Operator may discontinue this free project. Where reasonably practicable, advance notice will be provided so that users can export their dictionaries. Advance notice or a final export opportunity cannot be guaranteed in the event of an unexpected failure or security incident.
These provisions remain subject to mandatory legal requirements.
These Terms may be updated to reflect changes to the Website, its operation or applicable law.
Material changes will be notified through the Website or by email before they take effect, with reasonable advance notice where practicable. Where legally required, your renewed agreement will be requested.
Changes will not retrospectively remove rights or expand exclusions of liability for events that have already occurred.
These Terms are governed by Croatian law. If you are a consumer, this does not deprive you of mandatory protections available under the law applicable to you.
If any provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
